I was wondering when you have and graphic idea and you don't know how to draw and you hire someone else to do the drawing for you, who has the right to the graphic even though you didn't draw but gave him the idea?

The creator of the graphic holds the rights to it according to an article in Printwear magazine. I can't remember what issue. I'll track it down and publish it later.

i would think that you could incorporate into your payment, an acknowledgement that the payment includes all rights to the drawing

So should I get a written statement from him stating I have rights to the drawing?
I know when I had him draw it for me and explained to him I didn't want it to be stolen from me he told me to put copyright , my name and the date on anything I create with it and that it belongs to me. I still have email he sent me stating that. Plus I paid big time for it.
I also did a poor mans copyright by sending it to myself registered mail.
I really just want to hurry an get it out there.

Get a statement from him relinquishing full, exclusive rights to the artwork. Then use the same text in future dealings.

I can't find the article. I will continue to look. It concerned itself with an embroidered graphic but I can't see any difference.

Cochise is right.  The artist is owner of the graphic UNLESS he relinquishes all right to you IN WRITING.  If he/she is a right kind of person you shouldn't have any trouble.

He agreed to signing over rights to my cartoon. Smiley So now I have to write a agreememt relinquiche letter. Can anyone help me with that? or should I have a lawyer?

 I will leave most legal issues to attorneys or those with more experience than I BUT...would not a simple statement  that in exchange for $$ he/she relinquishes and assigns all rights to ........ your name...

I would not offer any more $$. Just ask him for a brief release. You could say something like, 'When I paid you the $325, I forgot to ask you for the release so that I can use the artwork as I wish'. See what he says. Lawyer would be unnecessary for this. He either will release it with one sentence or he won't.
